Terms and Conditions

1. Application and approval of terms and conditions

1.1 The order and sale of products via www.cycloconcept.com is offered to you by Cyclo Concept, independent trader under the name Cyclo Concept with registered office at 03727 Xaló, Calle Iglesia 14 (hereinafter the seller), these general sales conditions are those of the seller.

1.2 “Buyer” means any natural person or legal entity that purchases one or more product(s) via the web shop as well as every visitor to the web shop.

1.3 Current sales conditions apply to all sales offered on and realised via the web shop www.cycloconcept.com or other agreements concluded via the web shop. Everything in our web shop is listed online subject to typing errors.

1.4 These conditions apply to the exclusion of all other conditions, in particular those that apply to the sale or rental in the seller’s shop.

1.5 The seller is only active in Belgium and can therefore only accept your order if the delivery address is located in Belgium and this delivery address is not a PO Box address.

1.6 By placing an order via the web shop, the buyer declares to have taken note of the sales conditions and the buyer accepts the sales conditions by ticking on a box intended for that purpose.

1.7 If the event that one or more articles of these terms and conditions were to be declared invalid by a court decision, the other provisions of these terms and conditions of sale will remain fully in force.

2. Realisation of the agreement

2.1 A sales agreement will only be concluded between the seller and the buyer after the (potential) buyer’s order has been explicitly accepted by the seller who informs the buyer of this by means of a written confirmation.

2.2 The receipt of the confirmation by the buyer is the moment at which the agreement is concluded.

2.3 The seller reserves the right not to accept the order or to dissolve the agreement if necessary, without having to pay any compensation to the buyer, but reimbursing any sums that may have been paid. In particular when problems have arisen in the past with the person placing the order or his/her family members in the case of natural persons, as well as if problems have arisen in the past at the specified delivery address or in the case of invoices still outstanding. 

3. Prices 

3.1 The prices of the products are displayed in Euros with all taxes included.

3.2 The seller reserves the right to change his prices at any time, nevertheless the products will be invoiced on the basis of the rates that apply at the time the order is accepted.

3.3 The seller can not be held liable for (typing) errors that appear in his offers of which the buyer could reasonably assume that these concern (typing) errors.

3.4 The price due is the one stated in the written confirmation.

3.5 The seller reserves the right to change the price due after the conclusion of the agreement, for example on the basis of price changes affecting the shipping costs, new taxes or (typing) errors.

3.6 In the event that the price is increased, the buyer has the right to dissolve the agreement without any costs at his expense or obligation of the seller to pay any compensation.

3.7 The products remain the property of the seller until he has received the price fully and definitively.

4. Payment 

4.1 The following payment options are provided for products ordered via the web shop:

credit card: Visa, Mastercard 

internet banking: Bancontact/Mister Cash 

bank transfer.

When using the aforementioned payment systems, the buyer must of course also respect the possible conditions of the relevant providers, nor is the seller a party to the relationship between the buyer and the provider of the payment system.

4.2 The seller undertakes to guarantee the safety of the user of the web shop to the best of its ability, but can in no case be held liable for any damage caused by the use of the web shop and in particular for damage caused by third parties who would abuse the website or payment system.

4.3 The seller respects the rules regarding allowing the repayment of the amounts paid by the consumer in accordance with the Law of 13 June 2014 July 1991 on the right of return.

4.4 In the event that a payment term was stipulated and in any case 30 days after delivery, the buyer, by operation of law and without prior notice of default, owes a default interest for late payment of 1% per month and a compensation of 10% with a minimum of € 50.00.

5. Delivery 

5.1 The products are sent to the shipping address that is specified when ordering (home address or other address).

5.2 Obviously, the seller makes every effort to deliver the products within as short a time as possible. But the delivery times displayed in the web shop are only to be used as indication.

5.3 If the ordered goods are not delivered within 30 days, an additional term can be agreed between buyer and seller. In the absence of an additional term, the agreement will be dissolved by operation of law and the seller will repay any payment received within 30 days.

6. Warranty

Each product purchased via the Cyclo Concept sprl webshop entitles the customer to a minimum guarantee of 2 years from the date of delivery of the product, for any lack of conformity existing at the time of delivery, in accordance with the provisions of article 1649bis et seq. of the Civil Code.

7. Right of Renunciation 

7.1 The right of renunciation only applies to the purchase via the web shop by natural or legal persons who acquire or use these products for non-professional purposes only.

7.2 The Legislation of 13 June 2014 regarding the right of return on a purchase via the internet, allows the consumer to inform the seller within 14 working days after receipt of the product that he will abstain from the sale.

7.3 The goods must then be returned within a new period of 14 days after this notification at the expense of the buyer in the original packaging, together with all accessories, the instructions for use and (a copy of) the invoice/delivery note: Cyclo Concept, Calle Iglesia 14, 03727, Xaló.

7.4 Goods that are incomplete, damaged, used or soiled by the consumer shall be taken back, subject to the possibility of claiming compensation corresponding to the loss in value suffered by the goods as a result of the damage, incompleteness or use.

7.5 At the latest 14 days after acceptance of the return, the seller will refund any sums paid, with the exception of the direct costs of delivery.

7.6 Pursuant the Law of 13 June 2014 on the right of return, the right of renunciation does not apply to: the delivery of products that are manufactured according to the specifications of the consumer or that have a clear personal character or that can not be returned due to their nature or can quickly deteriorate or age, the delivery of audio and video recordings and computer software whose seal has been broken by the consumer.

8. Privacy 

8.1 Your personal data will be stored by the seller and kept for the entire duration of the personal account in your personal account to allow the seller to execute your transaction correctly. Once this data is stored, subsequent transactions will be dealt with more quickly. When placing an order, you will be requested to tick a box by which you give explicit consent to the processing of your personal data in accordance with these terms and conditions. This processing of personal data is absolutely necessary for the proper execution by the seller of the order placed by you.

8.2 The vendor observes the Belgian Law of 8 December 1992 with regard to the processing of personal data, amended by the Law of 11 December 1998 and from 25 May 2018 by the Regulation (EU) 2016/679 (GDPR), which takes into account the European Directive of 24 October 1995. This law stipulates that the person or company that collects data must have the consent of the person whose personal data is involved, that the data must be relevant, accurate and correct and that they must be collected for specific, clear and legal purposes. You can view, change and/or delete your personal details at any time in the personal account or by contacting info@cycloconcept.com. You also have the right to object to the processing by means of a notification to the aforementioned e-mail address, as well as to submit a complaint to the Privacy Commission. The visitor is assured of the protection of the privacy of his/her personal data by the use of an SSL certificate at Domain Validation level, issued by COMODO CA Limited.

8.3 The seller undertakes not to pass on any personal information to other organisations with commercial or non-commercial purposes.

8.4. Cookie policy 

Cyclo Concept collects your personal data by using cookies. Your consent is required under the applicable legislation regarding GDPR. You can withdraw your consent for the use of cookies by Cyclo Concept at any time.

Cookies are small text files which are installed on your computer or mobile device by Cyclo Concept. These cookies allow Cyclo Concept to collect information on your use of the website. Thanks to the cookies you will also be recognised on a subsequent visit, so you do not have to register again or so that you can make a quick purchase in the web shop. They also enable us to count visitors to the Cyclo Concept website and analyse how they navigate through the website. This way the visitors can be used for profiling purposes and we can continually improve the website. The visitor can withdraw his/her consent at any time by sending an email to info@cycloconcept.com. The Cyclo Concept website makes use of a number of cookies as listed in the following table. Cyclo Concept also makes use of cookies placed by third parties.

The Cyclo Concept website makes use of a Facebook Pixel. This pixel leaves cookies on your computer or mobile device. That means that your data on the Cyclo Concept website are maintained by the pixel. In this way, Cyclo Concept receives information on your behaviour on the website and on Facebook. That means you may be profiled for marketing purposes.

8.5. Newsletters 

The personal details of the visitor will also be used for sending the newsletter, provided a double opt-in has been obtained. A double opt-in means to the visitor ticks a box when entering the data that he/she wishes to receive a newsletter, then the visitor receives a confirmation e-mail in which he/she again has to verify that he/she wants to receive the newsletter. These details can be viewed, changed and deleted at any time by contacting us via email to the address info@cycloconcept.com. The visitor can also unsubscribe at any time by clicking on the link in the newsletter or by contacting Cyclo Concept.

9. Applicable Law

9.1 The sales to which the present sales conditions relate are subject to Belgian law

9.2 Only the courts of the judicial district of Dendermonde have jurisdiction.
